1. Acceptance

By creating a GIVA account or sending a Gift, you agree to these Terms and our Privacy policy. If you don't agree, please don't use GIVA.

2. What GIVA is

GIVA is a platform that lets you ("the Donor") send a Gift — a one-time charitable donation — to a registered charity ("the Charity"). GIVA is the technology that connects you to the Charity. GIVA itself is not the recipient of your Gift and is not a registered charity.

3. How a Gift works

You choose a Charity in the app.
You enter an amount.
You authorize a payment via Stripe. Your card is charged the gift amount + a Stripe processing fee + a 0.5% GIVA platform fee. The Charity receives the full gift amount.
Stripe transfers the funds directly to the Charity's connected Stripe account.
GIVA emails you a confirmation. The Charity emails you an official tax receipt within a reasonable delay (typically 4–6 weeks).

4. Fees

Each Gift carries:

Stripe processing fee — approximately 2.9% + $0.30, charged by Stripe and visible in the in-app breakdown.
GIVA platform fee — 0.5% of the gift amount, used to operate the platform.

Both fees are paid by you, the Donor. The Charity receives the full gift amount.

5. Tax receipts

Tax receipts are issued by the receiving Charity, not by GIVA. The Charity is solely responsible for the validity, timing, and content of any tax receipt. GIVA may forward your contact information to the Charity for that purpose.

6. Refunds

Charitable donations are generally final. If you believe a Gift was sent in error, contact us within 14 days at hello@thegiva.app and we will assist on a best-effort basis. Refund decisions ultimately rest with the receiving Charity.

7. Account

You must be at least 18 years old (or the age of majority in your province) to create an account. You're responsible for keeping your credentials secure. You can delete your account at any time from Profile → Settings → Delete my account.

8. Charities

GIVA verifies the identity of each Charity before they can receive Gifts via Stripe Connect Express. We do not however certify any Charity's mission, financial practices, or governance. Donate at your own discretion.

9. Acceptable use

You agree not to:

Use GIVA for fraud, money laundering, or any illegal activity.
Attempt to bypass our security or rate-limits.
Send Gifts on behalf of another person without their authorization.
Submit false information about a Charity, donor, or donation.

Violations may result in account termination and potential legal action.

10. No warranty

GIVA is provided "as is" without warranties of any kind. We do not guarantee that a Charity will issue a tax receipt, that a Gift will arrive instantly, or that the service will be available without interruption.

11. Liability

To the extent permitted by Québec and Canadian law, GIVA's total liability for any claim arising out of these Terms is limited to the GIVA platform fees you paid in the 12 months preceding the claim.

12. Changes

We may update these Terms as the platform evolves. Material changes will be highlighted in-app. Continued use after a change means you accept the new Terms.

13. Governing law

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein. Any dispute will be resolved before the courts of the judicial district of Montréal.
